The Department of Justice and Constitutional Development says members of the South African National Defence Force (SANDF) will not be excluded from using cannabis for private purposes.
The Department was briefing the NCOP’s Select Committee on Security and Justice on the Cannabis for Private Purposes Bill. In 2018, the Constitutional Court decriminalised the use of cannabis for private use. It gave Parliament 24 months to come up with legislation to regulate the use of cannabis for private use.
Parliament missed the ConCourt deadline but an extension was granted. The Bill was passed in the National Assembly last year and sent to the NCOP for concurrence.
The Department’s Legal Adviser Makubela Mokulubete, “The South African National Defence Force have made a submission to the effect that there are far more serious risks to allow members that is of the South African Defence Force to use cannabis, even privately, whilst in the service of the South African Defence Force and especially while on active duty. It is our submission chair that the Bill will be unconstitutional if we were to prohibiting members of the South Africa Defence Force from using cannabis in their private places. The Bill operates equally to all in the country, including the members of SANDF even if they are still on active duty. However, the Bill does not need members to use cannabis while on duty
