AfriForum hopes to win court challenge against CoCT’s property tariffs heard

Lobby group AfriForum said it hopes the Western Cape High Court will rule in its and the South African Property Owners Association (SAPOA)’s favour when their court challenge against the City of Cape Town’s new property tariffs is heard.

In July, the association filed an urgent high court application to have property tariffs implemented by the municipality reviewed and set aside.

AfriForum also filed its own court papers on Thursday to join the association’s court case, which will be heard in September.

SAPOA and AfriForum are challenging the city’s cleaning levy and its fixed charges for water and sanitation, which were implemented from 1 July.

They argued that the metro went outside the national legal framework to impose its municipal rates and taxes.

AfriForum’s Morne Mostert said they’re hoping the court will convince the city to change its stance.

Because of this disagreement, it is best that this matter is tested in court and because of the innovation that the city shows, we think that they must be given at least to the next financial to correct this.”

The city has previously slammed SAPOA’s court action, labelling it as an attempt to protect their own vested interests and to put their profits ahead of the people of Cape Town.
