The Judicial Service Commission (JSC) has resolved to recommend Judge Edwin Molahlehi to President Cyril Ramaphosa for appointment to the Labour Court and the Labour Appeal Court to serve as the Deputy Judge President of the court.
Molahlehi was the only candidate interviewed for the position. Currently, Molahlehi is a judge in the South Gauteng High Court in Johannesburg.
He was the presiding judge in the AfriForum v Economic Freedom Fighters case which dealt with the question of whether the song “Dubul’ Ibhunu” or “Kill the Boer” constitutes hate speech in terms of the Equality Act.
Molahlehi also heard the case against former African National Congress (ANC) Secretary-General Ace Magashule challenging his suspension from the ANC.
JSC Commissioner, Advocate Sesi Baloyi says, “For the Labour Court and the Labour Appeal Court, we were interviewing for the vacancy of Deputy Judge President and only one candidate was interviewed. That’s Judge E.M Molahlehi and the JSC decided to advise the President [Cyril Ramaphosa] to appoint Judge Molahlehi as Deputy Judge President of the Labour Court and the Labour Appeal Court
