Malusi Booi not ruling out suing State for wrongful prosecution after tender fraud charges withdrawn

Former City of Cape Town Human Settlements MMC Malusi Booi said he can’t rule out suing the State for wrongful prosecution.

The State on Friday provisionally withdrew the tender fraud case against Booi and others, including alleged 28s gang boss Ralph Stanfield and his wife, Nicole Johnson.

However, the married couple will remain in prison to face a string of gang-related charges.

The case relates to a billion rand housing tender fraud under Booi’s tenure as MMC.

Booi said that while he was ready to move on with his life, he was also considering taking legal action against the prosecution for wrongful prosecution.

That’s up to my legal team, and post this process, we’ll have an engagement with my legal team. So, post that process, we’ll be able to make a determination.”

However, Booi added that he was happy to be a free man and could not wait to put the ordeal behind him.
