The South African Students Congress (SASCO) has declared the current National Student Financial Aid Scheme (NSFAS) board illegal, accusing Higher Education Minister Nobuhle Nkabane of violating appointment procedures. According to SASCO, the minister failed to adhere to the legal requirements outlined in the NSFAS Act.

Violation of the NSFAS Act

During a media briefing held at the African National Congress (ANC)’s Luthuli House on Sunday, SASCO addressed concerns about the Department of Higher Education, NSFAS, and Sector Education and Training Authorities (SETAs).

SASCO President Alungile Kamtshe stated that the minister did not consult student organisations properly when appointing the 12-member board in February. The NSFAS Act mandates 13 members on the board, with three representing national student organisations.

Student Representation Ignored

Kamtshe argued that the absence of proper student representation renders the board’s appointment flawed and invalid.

“Three [members] are designated to be nominated by national organisations representing students. That’s why we declare the board illegal,” Kamtshe said.

Warning of Mass Action

Kamtshe warned that if their demands for a legally constituted board were ignored, SASCO would mobilise students across the country in protest.
